1. The sale is subject to the conditions of the sale herein set out and any announcements made by the AUTIONEERS at the commencement of or during the course of the sale. The SELLER and the PURCHASER are deemed to have knowledge of the applicable conditions and of all the aforesaid announcements. The conditions and announcements are applicable to any sale before the commencement, during the course and after the conclusion of the auction.

2. The sale is conducted by ECO AUCTIONEERS (PTY) LTD, as agents for the SELLER, who acknowledge that there are no encumbrances on the assets sold and that they are his property.

3.1. The sale shall be conducted in the absolute discresion, and under the sole control of the AUCTIONEERS.
3.2. Each bid shall constitute and offer to purchase for the amount thereoff and may not be withdrawn, until refused.
3.3. The AUCTIONEER reserves the right to refuse the bid of any person without giving any reasons therefore.
3.4. The highest bidder shall, subject to any provision herein contained and any reserve placed on any lot, be the PURCHASER.
3.5. The bidding price does not include VAT.

4.1. Any BONA FIDE error made by the AUCTIONEERS shall not be binding on the AUCTIONEERS, the SELLER or the PURCHASER and shall be capable of rectification immediately upon its discovery.
4.2. In the event of a dispute arising amongst bidders, the assets in dispute shall, at the discretion of the AUCTIONEERS, be re-offered.

5. The AUCTIONEERS are in no way liable for or bound by:
5.1. Any representations of warranties contained in any advertisements or catalogues relating to the sale.
5.2. Any representations or warranties, express or implied, made or given by or on behalf of the SELLER or any third party.
5.3. Damages suffered by any third party arising from any act or omission of any of the employees of the AUCTIONEERS.
5.4. Any damage caused to or by any lot whilst under the care or supervision of the AUCTIONEERS of any of its employee and whether arising before, during or after the auction.

6. Each and every lot is sold voetstoots, without any warranty, guarantee, or representation and al risk appertaining to a lot shall pass to the PURCHASER immediately upon acceptance of the bid. notwithstanding the fact that delivery to the PURCHASER has not bee affected.

7. The purchase price plus VAT is payable in cash / bank guaranteed cheque to the AUCTIONEERS immediately upon the conclusion of the sale whereupon the PURCHASER shall be entitled to delivery of the lot purchased.

8. Ownership of a lot shall remain vested in the SELEER until payment of the purchase price plus VAT has been effected by the PURCHASER.

9. Should the AUCTIONEERS be obliged to take action, in the event of the default of the PURCHASER, the PURCHASER shall be liable for all costs relating to the recovery of the amount owing, all damages suffered by the AUCTIONEERS in consequence thereof and all legal costs on an Attorney and Client scale, plus collection charges at the ruling rate.

10. No right of set-off which may exist between the PURCHASER and the SELLER shall be enforceable in respect of any right of obligation arsing from the scale concluded in terms thereof.

11. Any entry made in the AUCTIONEERS vendu roll shall be conclusive evidence of the transaction recorded therein, and shall be binding upon the SELLER and the PURCHASER. A certificate issued by an officer of secretary of the AUCTIONEERS reflecting the amount owing by the PURCHASER shall be PRIMA FACIA proof thereof for purchases of any legal proceedings of for any other purpose.

1. Die verkoping is onderworpe aan die verkoopsvoorwaardes hierin vervat en enige sodanige aankondigings gemaak deur die AFSLAERS aan die begin en gedurende die verloop van die verkoping. Die KOPER en die VERKOPER word geag kennis te dra van die toepaslike voorwaardes en alle hierondergenoemde aankondigings. Die voorwaardes en aankondigings is van toepassing op enige verkoping aangegaan tydens die veiling.

2. Die verkoping word hanteer deur ECO AUCTIONEERS (PTY) LTD, as agente vir die VERKOPER, wat erkenning gee dat daar geen beswaring op die bates te koop is nie, en dat dit sy eiendom is.

3.1. Die verkoping sal geskied in die absoluut diskresie en uitsluitlike kontrole van die AFSLAERS.
3.2. Elke bod sal ‘n aanbod wees om te koop vir die bedrag daargestel en mag nie teruggetrek of herroep word nie, totdat dit afgewys word.
3.3. Die AFSLAERS behou die reg om ‘n bod van enige persoon te weier sonder om enige redes daarvoor te verskaf.
3.4. Die hoogste bieder sal, onderworpe aan enige voorwaarde hierin vervat en gereserveer op enige lot, die KOPER wees.
3.5. Die bodprys sluit nie BTW in nie.

4.1. Enige BONA FIDE foute gemaak deur die AFSLAERS sal nie bindend wees op die AFSLAERS, KOPER of VERKOPER nie en sal onmiddelik by ontdekking daarvan reggestel word.
4.2. Items betrokke in ‘n dispuut tussen bieërs sal na diskressie van die AFSLAERS her-aangebied word.

5. Die AFSLAERS is nie aanspreeklik vir of gebonde aan:
5.1. Enige voorstellings of waarborge vervat in enige advertensies of katalogusse met betrekking tot die verkoping nie.
5.2. Enige voorstellings of waarborge, uitsluitlik of geimpliseerd, gemaak deur of ten behoewe van die VERKOPER of enige derde party nie.
5.3. Skade gely deur enige party voorspruitend uit enige doen of late van enige werknemer van die AFSLAERS nie.
5.4. Enige skade veroorsaak aan of deur enige lot terwyl dit onder die toesig of bewaring van die AFSLAERS, of enige van hulle werknemers is, veroorsaak voor, gedurende of na die veiling.

6. Iedere en elke lot word voetstoots verkoop, sonder enige waarborg. Vrywaring of voorstelling en alle risikos verbonde aan ‘n lot sal oorgaan op die KOPER onmiddelik met die aanvaarding van die aanbod, nieteenstaande die feit dat lewering nog nie deur die VERKOPER geskied het nie.

7. Die koopprys plus BTW is betaalbaar in kontant / bank-waarborg tjek aan die AFSLAERS onmiddellik na afloop van die verkoping, waarna die KOPER geregtig sal wees op lewering van die lot deur hom aangekoop.

8. Eienaarskap van ‘n lot sal bly vestig in die VERKOPER totdat betaling van die koopprys plaasgevind het.



9. Indien dit nodig sou wees vir die AFSLAER om stappe te neem in gevalle waar die KOPER versuim, sal die KOPER aanspreeklik wees vir alle koste met betrekking tot die verhaal van die bedrae geld verskuldig, alle gevolgskade van die AFSLAERS in verband daarmee, en alle regskoste op ‘n prokureur en kliënt skaal, plus invorderingskommissie op die heersende skaal.

10. Geen reg van skuldvergelyking wat tussen die VERKOPER en KOPER mag bestaan sal afdwingbaar wees met betrekking tot enige reg of verpligting voorspruitend uit ‘n verkoping in terme hiervan.

11. Enige inskrywings gemaak in die AFSLAERS se vendurol sal voldoende bewys wees van enige transaksie daarin aangeteken en sal bindend wees op die KOPER en VERKOPER. ‘n Sertifikaat uitgereik deur die beampte of sekretaresse van die AFSLERS waaruit ‘n bedrag deur die KOPER versuldig blyk, sal PRIMA FACIA bewys wees daarvan, en geldig wees vir die doeleindes, ook met betrekking tot regsgedinge.
